Is Delta-8 Legal in North Carolina? 

Because Delta-8 is now a federally legal substance, the answer to this question is YES. Delta-8 is legal in North Carolina. Hemp used to be illegal, under the Controlled Substances Act of 1970. The game changer was in 2018, under the Agricultural Improvement Act (otherwise known as the Farm Bill). This bill federally legalized all hemp, and hemp-derived products (that contain no more than 0.3% Delta-9 THC). Marijuana (Delta-9) is still treated as a controlled substance, making it still illegal under federal law. Since Delta-8 is derived from hemp, it’s legal under the Farm Bill, and can be purchased legally in the state of North Carolina.     


Will Delta-8 Show up on a Drug Test? 

Depending on how much Delta-8 you decide to consume (or how regularly you consume it), it IS possible for you not to pass a drug test. This is because Delta-8 THC has similar metabolites to Delta-9 THC, so it’s advisable to not use Delta-8 products if you need to be drug tested regularly. Make sure to take the right precautions before ingesting, or using Delta-8.
