Does CBD Require a Prescription?

Myths About CBD: CBD Requires a Prescription

There is sometimes a misunderstanding from a curious inclined audience as to how one obtains CBD. Instead of doing their research, individuals sometimes will assume that a prescription from a medical doctor is required in order to obtain this cannabinoid. This stops some individuals from seeking CBD as a medicine, even if they could potentially benefit from it.

One of the main contributing reasons for this CBD misconception is the recently FDA approved drug called Epidiolex. This drug is extremely significant because it marks the beginning as the world’s first CBD-based prescription drug. In order for an individual to receive Epidiolex a doctor’s prescription is required for purchase.

In contrast this prescription law does not apply to hemp based CBD products that are not branded as the prescription medication Epidiolex. Medical doctors cannot prescribe CBD products aside from Epidiolex since these products are not considered to be classified or recognized by the FDA as prescription drugs.

It is important for individuals to understand the difference between hemp derived CBD products, and marijuana derived CBD products. When analyzing the contrast between these areas of products, the first thing to come across of course is the fact that some products are hemp based, while other products are marijuana based.

Depending on your state, you may be required to receive a recommendation or prescription for a “medical marijuana card”, (also known as “MMID” or “cannabis card”),  from a medical doctor in order to receive marijuana based CBD products from storefront dispensaries. These products often also contain percentages of THC higher than 0.3%, while in contrast hemp based CBD products are required to remain below 0.3% THC.

There is also no legal requirement for an individual to obtain a prescription in order to purchase hemp based CBD products, there are however individual state laws that consumers need to take into consideration when seeking consumable products. It is always important for individuals to stay educated on their local, state, and Federal laws in order to protect themselves and their rights as consumers. Be sure to stay up to date regarding both current hemp and marijuana laws within your state in order to best understand the full picture and your rights as a consumer.
