Most cannabis laws are still ongoing across the globe, but with the trend train leaning towards legalization, it seems as though widespread cannabis reform is soon to be a reality throughout most parts of the world. That being said, since cannabis laws are frequently changing by states and regions, there's still many questions revolving around where CBD is legal, and how you should go about traveling with it. Acquiring and using CBD in Mexico is relatively easy, but only if you’re aware of the laws. If you’re curious about this, then we’re here to help you with everything you need to know about buying CBD in Mexico, and if you can travel with it.
Is CBD legal in Mexico?
Right now, the current legal status of marijuana in Mexico is in limbo. But in short, yes. CBD is currently legal in Mexico. To an extent, medical marijuana has been decriminalized (in 2009 it became legal to have up to 5 grams of any THC substance), but CBD is considered to be a medical treatment, and can be bought in store, or online, without punishment. Currently, CBD products containing less than 1% of THC are sold legally, just like supplements (like vitamins such as fish oil or omega-3). Make sure that the CBD substance you’re purchasing or using has less than the 1% THC ratio.
Even though the current status is legal, because of how “new” these CBD laws are, it’s still not recommended to use CBD substances in public, especially if you’ve traveled with them into Mexico.
Can I travel (fly or drive) with CBD into Mexico?
Yes, you can. Mexico is now one of the countries that allows you to take CBD across its borders. Since back in 2017, Mexico passed legislation that legalized CBD (with less than 1% THC content), so CBD is considered a supplement. Supplements are not illegal, so it’s not illegal to transport CBD over into Mexico, or illegal to take it out with you (depending on where your state/country's regulations are). Be sure that if you’re traveling with any form of CBD, that it’s clearly labeled, and states that it’s hemp-derived to prevent any issues with law enforcement.
Can I buy CBD (in a store or online) in Mexico?
Yes, you can purchase CBD online in Mexico. Many residents, as well as long term travelers within Mexico, like to buy CBD online because it’s convenient, and offers a wide variety of products. There are currently only a few CBD companies that are offered in local shops within Mexico, so ordering online is a preferred method.
But it’s not that simple. Depending on how much you plan on ordering, to import CBD products into Mexico, you need to apply for approval in accordance with COFEPRIS (the main regulatory body for CBD supplements that approved and legalized 38 variations of CBD products to the public). Once this process is completed, it becomes fairly simple to order CBD online, and have it shipped to you legally. Don’t forget that your product cannot contain more than 1% of THC if you want to have it sent into Mexico. Be sure to check before purchasing.
As of now…
Mexico is in a slight “grey area” in terms of cannabis. Hopefully, these answered a few of your CBD questions. Even though the laws within the country are becoming looser, they’re in the works to make Mexico a leader in cannabis for Latin America.
